    APP TERMS OF USE

    This Cedar Application (“App”) is offered to you by Cedar Electronics Corporation (“Cedar”).  In order for you to use this App, the following are some terms of use that you must acknowledge and accept.

     

    WHO CAN USE THIS APP

    You must be at least 18 years of age to use this Cedar App.

     

    ACCOUNT ACTIVATION AND DEACTIVATION

    In order to access and use this App you must do the following:

    1. Download the App.
    2. Create a Cedar Account for use with the App and accept these Terms of Use.
    3. Acknowledge that your Cedar Account and this App are forms of Cedar communication to you in relation to any changes in the App of the Terms of Use.
    4. Activate the App by connecting to your device.

     

    You may only create a Cedar Account and use the App if you accept and comply with these terms of use and the applicable laws.  Any use of the App by anyone under the age of 18 years of age is strictly prohibited and is a violation of these terms of use.

     

    You agree to the following when using the Cedar App:

    1. Accurately provide all contact and other information requested by Cedar and notify Cedar of any change in your information.
    2. Maintain the confidentiality of your Cedar Account login and for all activities that occur under your Cedar Account.
    3. You may choose to deactivate or delete your Cedar Account by fill out the request form below:

     

     

    LICENSE TO USE

    You have no ownership rights in the App software.  You only have a license to use this App in connection with the purpose described on the Android or Apple Device owned or controlled by you.  This license is non-transferable and is between you and Cedar.

     

    Cedar owns the copyrights, patents, trademarks, service marks and trade dress rights to all the materials and content displayed on the Cedar App.  You may not reproduce, modify, create derivative works from, display, frame, perform, publish, distribute, disseminate, transmit, broadcast or circulate any such materials or content to any third party without Cedar’s prior written consent. Cedar retains all rights not otherwise granted in these terms of use.  You agree not to publish, display, disclose, rent, lease, modify, loan, distribute or create derivative works based on the Cedar App or Cedar App software or any part thereof.  You also agree not to reverse engineer, decompile, translate, adapt or disassemble the Cedar App software, and you agree not to attempt to create the source code from the object code of the Cedar App software.

     

    WARRANTIES

    The Cedar App is provided to you “as-is”. Cedar cannot warrant the content of the Cedar App since the use of the App is dependent on external circumstances such as your mobile device, Wi-Fi network, your internet service provider and mobile device carrier upon which Cedar has no influence. Thus, Cedar cannot warrant any of the following activity in relation to the Cedar App: availability, uptime, accuracy of results, accuracy of data, storage of data, accessibility in all countries, reliability of any resulting notifications, any specific level of rewards or other benefit. CEDAR IS NOT LIABLE FOR AMOUNTS EXCEEDING THE PURCHASE PRICE FOR THE APP. 

     

    LIABILITY

    In the event that the Cedar App does not work or any content lost, to the fullest extent permitted by applicable law, we cannot accept any liability for any damages incurred as a result of your use of the Cedar App.

     

    TERMINATION OR SUSPENSION

    These terms of use will remain in full force and effect so long as you continue to access or use the Cedar App or until terminated in accordance with the provisions of these terms of use.  Cedar may suspend or terminate your rights to use the App or terminate these terms of use with respect to you if Cedar reasonably believes that you have used the Cedar App in violation of these terms of use.  Upon termination, you are no longer authorized to use or access the Cedar App.  Cedar reserves the right to modify, suspend or discontinue the App or any part thereof with or without notice to you.  You agree that Cedar will not be liable to you or to any third party for the exercise of the aforementioned right.

     

    UPDATED TERMS OF USE

    From time to time, we may update these terms of use. If we make changes, we may send you an e-mail message or other communication telling you about the changes and any choices you may have or action you can take before they go into effect or we may temporarily highlight the new or revised section in these terms of use or temporarily post a prominent notice on our website at anz.escortradar.com/pages/privacy-policy. Your inaction or continued use of the App after any such notice is your agreement to these changes.

     

    THIRD PARTIES

    When you use the Cedar App it is possible that you will use a service, download a piece of software, or purchase goods that are provided by a third party. Those third party services and products may have their own applicable rules that you should be aware of which are separate from these terms of use. You acknowledge that you are responsible for all fees such as data usage fees, charged by third parties like your mobile carrier or ISP.

     

    JURISDICTION

    These terms of use are construed, interpreted and governed by the laws of state of Illinois, United States without regard to conflicts of law provisions.

    REPRESENTATION AND WARRANTS

    You represent and warrant that (1) you are not located in a country that is subject to a United States Government embargo or designated as a terrorist supporting country; and (2) you are not listed on any United States Government list of prohibited or restricted parties. Also you irrevocably grant the mobile application store where you have purchased the Cedar App the right to enforce these conditions against you as a third party beneficiary thereof. You agree that you will not directly or indirectly, export or re-export the Cedar App software to any country for which the United States Export Administration Act or similar law or regulation requires an export license or other United States Government approval, unless the appropriate export license or approval has first been obtained.

     

     

    APP- PRIVACY NOTICE

    The ESCORT Live! App. The App uses personal data collected by the App. This Privacy Notice is to help you understand our privacy practices when you use our Services, including what information and personal data we collect, why we collect it and what we do with it, as well as your individual rights.  The controller of your personal data under this Privacy Notice is Cedar Electronics Corporation with an address at 1701 Golf Road, Tower 3, Suite 900, Rolling Meadows, IL 60008 (“Cedar”, “our”, “we”, or “us”).

     

    WHAT INFORMATION AND PERSONAL DATA WE COLLECT AND FOR WHICH PURPOSE

    We receive or collect information and personal data as described below when we provide our Services, including when you access, download and install the App, below are some examples:

    • Identity Data includes first name, last name and business name
    • Contact Data includes address, email address and telephone numbers; Emergency Contact information (all optional) includes first name, last name, mobile number and email
    • Profile Data includes your username and password; blood type (optional), allergies (optional), medication (optional); Insurance Information (optional) includes insurance number, phone number, email, policy number
    • Payment Data includes credit card number and expiration date
    • Preferences Data includes car make/model/year and personal product interests (optional)
    • Technical Data includes IP address and your login data (IP address may be used to infer your location)
    • Other Information includes information that, by itself does not individually identify you, such as browser type, operating system, the webpages you viewed and how long you viewed them

    Account Data.  We collect your personal data when you create a Cedar Account. You may login to the App using a Cedar Account or by using your social media profile. 

     

    The personal data we collect may include your name, email address, country, language and password. We also process information on your App usage, including your session, login and authentication information, which we use to manage your account.

     

    The personal data we collect when you use your social media account to login includes your basic public profile, profile photo, identifier, gender, profile URL, birthday, homepage, location and authentication purposes.

     

    We use your Cedar Account Data to create and manage your account and provide personalized Services. When you create a Cedar Account to login to the App, we will verify your username and password, to communication with you in response to your inquiries, to send you strictly service-related announcements, or direct marketing communication in the case that you have provided consent. You may also participate in promotions or contests run or participate in surveys. 

     

    Your Account Data is used to provide our Services which we consider necessary for the performance of a contract to which you are a party and lawful under GDPR Article 6.1.(b) of Regulation (EU) 2016/679.

     

    Cookies and Analytics Data.  We use cookies, tags or similar technologies (“Cookies”) to operate, provide, improve, understand and customize our Services.  Cookies allow us to recognize your mobile device and collect information and personal data including your unique user device number, the IP address of your mobile device, the type of mobile internet browser or operating system you use, session and usage data, or service-related performance information, which is information about your use of the App. We also use this information to show your country specific content (including information in your local language).

     

    Ratings and Review Data.  If you write a review or rate the App on the app store, we may process such information to respond to your comments and questions, understand your perception of the App and to generally improve the App. We are able to see your app store username, ratings, comments and any other detail you provide us or make publicly available.  Unless you require us to do so, we do not link this information to your account credentials or any other information we hold from you. When you require customer support, we may use your data to follow up on your case and guide you through our customer support process.

     

    We consider the processing of your Ratings and Review Data to based on a legitimate interest of Cedar and lawful under GDPR Article 6.1.(f) of Regulation (EU) 2016/679.

     

    Customer Support Data.  If you require customer support, we may ask you to provide us with information related to your use of our Services, and how to contact you so we can provide you with the required support. We provide our Services, including providing customer support, improving and fixing our Services. We use your information to respond to you when you contact us.

     

    We consider the processing of you Customer Support Data to be necessary for the performance of a contract to which you are a party and lawful under GDPR Article 6.1.(b) of Regulation (EU) 2016/679. In some situations the processing of your Customer Support Data is based on a legitimate interest of Cedar and lawful under GDPR Article 6.1.(f) of Regulation (EU) 2016/679.

     

    Marketing Information.  We use your name and email to send you newsletters and other marketing information through messages in your App and on email. The marketing information will be about products and services from Cedar. The legal basis for providing you with marketing information is your consent in accordance with GDPR Article 6.1.(a) of Regulation (EU) 2016/679

     

    Permissions.  The App may request your permission to access your mobile device’s storage capabilities, sensors, or other features such as photos, calendar, contacts, camera, Wi-Fi, geo-location or Bluetooth. We will require access when strictly necessary to provide the Services.  Bluetooth is required to establish a connection to compatible ESCORT products.  Geo-location is required to provide directions and maps as well as shared alerts.

     

    We will only use your personal data when the law allows us to. We have set out below, in a table format, a description of all the ways we plan to use your personal data, and which of the legal bases we rely on to do so. We have also identified what our legitimate interests are where appropriate.

     

    Note that we may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your data. A current list of third party providers that have access to collected personal data include, Amazon AWS and Firebase.

     

    By using the App and by providing your consent you acknowledge that your personal information is shared as described here.

     

    International transfers. In some cases, we will be transferring personal data to countries outside the EU/EEA. The country/countries may have been deemed by the Commission of the European Union to have an adequate level of protection of personal data, and otherwise we will provide appropriate safeguards for the transfer through the use of "Model Contracts for the Transfer of Personal Data to Third Countries", as published by the Commission of the European Union, or any other contractual agreement approved by the competent authorities.

     

    HOW LONG WE KEEP PERSONAL DATA

    Your personal data will be stored by us for as long as necessary in order to fulfil the purposes described above in this form and comply with minimum retention periods under applicable data protection laws. However, unless otherwise required by applicable data protection laws, this period will last for no longer than 10 years from the collection of your personal data, or 10 years following your latest use of the mobile app, whichever period is the longest.
